Sony sued for non-compliance with warranty agreements on defective PS5 controllers

Sony is it facing one class action lawsuits over reported failure to fulfill warranty agreements on PlayStation 5 controllers with obvious “operating” errors.

In a lawsuit filed in the southern district of New York on February 12, the Japanese conglomerate is accused of violating consumer fraud laws and violating warranty agreements related to PS5 DualSense wireless The controller, as the suit claims, has an obvious flaw that allows the characters to slide across the screen, even when a user is not moving the joystick.

Lmarc Turner, the main plaintiff listed in the complaint, claims that he immediately experienced one drive problem with the controller after he took the PS5 home with him in early February. The DualSense controllers were released next to PS5 console in November to much fanfare after selling out via pre-order pretty much everywhere.

The lawsuit requires Sony to launch one recall or free replacement program to replace defective controllers for all class members, and also requires claims payments to be paid to consumers to compensate them to buy new controllers or others out of pocket to fix the alleged defect.
